Specific Terms and Conditions for The GARAGE STORE:

The use of this site is governed by the policies, terms and conditions set forth below . Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions. Your submission of any purchase order to Garage Entertainment Aust Pty Limited indicates acceptance of these terms and conditions. These terms and conditions shall supercede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by Garage Entertainment. Garage Entertainment reserves the right to make changes to this site and these terms and conditions at any time.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Garage Entertainment reserves the right at any time after receipt of your order to accept or decline your order for any reason. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

Liability

Garage Entertainment is not liable for any losses or damages caused by this website or any website linked to or from this website. We reserve the right to refuse any order without giving reason. Upon cancellation of an order we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method received.

Delivery

The delivery times provided by Garage Entertainment are estimates only. Garage Entertainment will not be held accountable for late deliveries or loss or damage relating to late deliveries. In the event that multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided. Please ensure you enter the correct delivery address. Garage Entertainment can not be held responsible for incorrectly entered delivery addresses.

All orders will be shipped as available or as released. This is to ensure that you receive your items as quick as possible, noting:

  • If your product is in-stock, we will post it as soon as possible, usually within 24-48 hours.
  • If you have purchased a Pre-Release item, we will post the product to you within 1-2 working day of release.
  • If your product is out of stock it will need to be ordered in from the supplier. These orders are usually sent to you within 10-15 working days of the initial order. We will advise you by email if there are any delays expected. However, if Garage in unable to obtain stoke of an item which has been ordered, Garage will offer a replacement product(s), and if that is not suitable as an option for you, Garage will refund the full amount of the item which is unavailable only.

We aim to keep the postage costs to a minimum, but there are costs associated with the handling despatch and freight of your order. The costs are listed at the point of order processing, which is visible prior to your transaction acceptance.

Acceptance of the goods

The buyer is responsible for inspecting the goods for fault and notifying us within 5 working days of receiving the goods should there be a fault.

Returns Policy:

To assure prompt and accurate credit on returned products, we ask that you follow these steps:

  • Credit or adjustment is given on mistakes that are our fault, provided you contact our Customer Service Department at [email protected] within five (5) days from receipt of merchandise.
  • Returns for which the customer ordered incorrectly, will be charged for postage.
  • We do not refund the shipping portion of the order for delays that are outside our control. The customer is able to return the goods to us if arrived too late for a refund however the postage for the return is the customers responsibility.
  • Credit will not be issued for returned material that has been marked, altered, or abused.
  • All returns must include a written explanation and a copy of the invoice or packing list.
  • No returns are accepted COD. Send all returns prepaid.
  • Absolutely No returns are accepted after thirty (30) days from date of invoice.
  • Damaged, lost or short shipments should be reported to Australia Post, or courier as may be appropriate, immediately. Then contact us so that we can reship the product and place a claim. Keep damaged goods and containers until notified otherwise.

Warranties and formats

Garage Entertainment warrants that it is responsible for the supply of the product as supplied by the producer. Garage Entertainment warrants that the product will look and work in accordance with the imagery and working requirements as would generally be understood with DVD and other such product offering. Note always that as an Australian based business, many of our DVD titles (not all) are in PAL format and possibly region coded. As 95% of DVD players now play both PAL and NTSC format discs, this is unlikely to be an issue, however if you are concerned then you should ask Garage prior to purchasing about the format and region coding specific to the DVD of interest.

Garage Entertainment is not responsible for the rights (such as music and footage) which are the responsibility of the producer of the respective title, and as such can not be held liable for any breach of copyright, or other legality associated with any inadequate licencing or other approval required for the release of the title.

Pricing and Sales Tax

Prices are subject to change without notice. All pricing listed and credit cards charged are in Australian Dollars.

GST is added to the order price at checkout for any orders received within Australia. This is clearly marked at the checkout prior to payment (as a separate line item) and your continuance to payment accepts this addition of tax.

Order cancellations

If notified before goods have been dispatched, Garage Entertainment can accommodate order cancellations. If items have been shipped, Garage Entertainment reserves the right to refuse order cancellation or charge a cancellation fee should we be able to request the return of the package from our delivery service.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Garage Entertainment shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Garage Entertainment shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Garage Entertainment shall immediately issue a credit to your credit card account in the amount of the charge.

Even so, the information that we do collect will not be sold, rented or traded to third parties, other than to members of The Garage Entertainment Group, without your consent. Where you provide such consent, you also consent to third parties sending you promotional information. Garage Entertainment does use information gathered to keep customers up to date with new products, offers and prices that are available. These offers may be based on information you have provided and on your history with us as a customer.
